Prenuptial Agreements

  • These are agreements made between those contemplating marriage or entering into a Civil Partnership. The content of a Prenuptial Agreement can vary widely, but commonly includes provisions for division of property and spousal support in the event of divorce, separation or dissolution of a Civil Partnership. 
  • These agreements are not binding on UK Courts as they are in America but recently they do appear to be now given increased recognition in English Law. Recent decisions in the Supreme Court mean that Judges are under a greater duty than ever before to give due weight to any Prenuptial Agreement into which a spouse has entered freely. This effectively means that married couples and civil partners are increasingly able to regulate the future enjoyment of their assets.
